Near the beginning of this case I said that the family of Harry must file charges in the Philippines, know who to pay and continue to demand that this case be completed while they are in the Philippines or this case would not be resolved any time soon. What I said has proven to be very true. Harry's family did not file charges in the Philippines that I know of. They did not pay the right people as required to get the case moving. And they are not here every day demanding justice until everyone gets tired of hearing from them and finally does something. That's the way things work in the Philippines.

 

Even with local crimes, the victim's family has to file charges, not the police. Once that is done, the police bring the 2 parties together to reach a cash settlement or go to court, unlike the rest of the world.

A thought crossed my mind. With all the threats to James, wonder if he could prove it was Jane behind intimidation of witnesses? If a connection could be made then would be nice if the US Government were to get involved as she is making "Terrorist" threats to a US Citizen. Our government likes putting its legal fingers into almost anything. Then Jane could look forward to having to look over her shoulder the rest of her life because the US is willing to wait years.

You are correct and some FBI agents like making international trips.

CANADIAN EXTRADITION PROCESS


GENERAL OVERVIEW


 


 



Request for extradition




 




·        A foreign country or entity is allowed to make a request for extradition of a person who is wanted to stand trial or to serve a sentence, if that state or entity is an extradition partner under the Extradition Act.




 




·        A person may be extradited from Canada only if the alleged criminal conduct in respect of which the extradition is requested is recognized as criminal by both countries.  This is the principle of double criminality.




 




·        As communications between states are privileged, all information related to specific cases is confidential and cannot be released publicly until an arrest is made under an extradition warrant. A court may also order that the file be sealed, in which case the information could not be divulged.




 




·        The foreign country may seek the extradition of a person in two ways: by providing Canada with a formal extradition request and supporting documentation or by requesting the provisional arrest of a fugitive, which must then be followed by a formal extradition request.




 




Arrest




 




·        Upon the arrest (whether provisional or following the formal request for extradition), the person is brought before a judge of the Superior Court of the province or territory where the arrest was made to be spoken to and to set a time for a bail hearing.




 




·        When the arrest is provisional, the country or entity has a set number of days (from the date of provisional arrest) to submit its formal request and documentation.




 




·        Counsel with the Department of Justice’s International Assistance Group, on behalf of the Minister, must determine within 30 days after the time period provided to submit the formal extradition request whether an Authority to Proceed will be issued. 




 




·        The Authority to Proceed authorizes an extradition hearing to be held to consider whether the arrested person should be committed for extradition.




 




·        Counsel for the Attorney General of Canada handles cases on behalf of requesting states or entities. They initiate and conduct proceedings before a judge of the Superior Court of the province or territory to seek an order for the committal for extradition.




 




Extradition hearing (Judicial phase)




 




·        At the extradition hearing, the judge hears the case in two ways: If the individual is sought to stand trial, the judge determines if the evidence provided by the extradition partner is sufficient to commit the person for trial in Canada if the conduct had occurred in this country. If it is for imposition or enforcement of sentence, the judge determines if the conviction was in respect of conduct that would be punishable in Canada, including evidence of identification. 




 




·        If the presiding judge is satisfied with the evidence, he or she will order the person committed for extradition pending the decision of the Minister of Justice on surrender.  Otherwise, the person is discharged and released.  




 




·        The judicial phase of the extradition process is a determination only that the evidence is sufficient to warrant that the person be extradited.  It is not a trial.  A trial will take place in the requesting state or entity, if surrender is ordered.




 




Surrender of person ordered to be extradited (Ministerial Phase)




 




·        The Minister of Justice makes the decision with respect to whether the person will be surrendered to the extradition partner.  




 




·        At this phase of the process, commonly referred to as the executive or ministerial phase, the Minister will receive and consider any submissions from the person committed for extradition or counsel with respect to why he or she should not be surrendered, or concerning any conditions that should be attached to the surrender.




 




 




Possible appeals




 




·        The person may appeal the decision of the extradition judge and/or apply for judicial review of the Minister's decision to a Court of Appeal. 




 




·        If the appellate Court upholds the decisions of the extradition judge and the Minister, the person may seek leave to appeal either or both decisions to the Supreme Court of Canada.




 




·        The above does not take into account the possibility for any person to waive all or part of the extradition process.

Though Jerome Davocion, Johnny Parian, and Jeffery Parian have repeatedly been identified while they were stalking and trying to intimidate PNP investigators, myself, other witnesses, and other expats.  At this point it is only circumstantial as it directly relates to Jane Doyle and has yet been proven in court. I do not hold much faith that the US Government will do anything.

You are correct the victim's family has to file charges which means an orphan will never get justice because there's no family to file charges and the victim will not get justice if the family committed the crime or if the victim's family lives in another country and are unaware that they must file the charges, which brings up the questions, why didn't the victim's closest relative file charges before she fled to another country?  This action is an indication of guilt. If Jane is innocent she would have helped with the investigation and she would have been the one who filed the charges.

The family of slain Fredericton businessman Harry Doyle has written to the Philippine Embassy in Ottawa asking for the arrest of his widow.

  Harry Doyle was gunned down on a beach in the Philippines on Aug. 12, 2012. His widow, Jane Doyle, came to Fredericton shortly afterwards and has been living in the city ever since. Harry Doyle’s sister, Joan Doyle, said it’s been an exercise in patience as the family has waited for a yearlong investigation by the Philippine National Police to be completed. Joan and Anne Doyle travelled to the Philippines last year on their attorney’s advice to say they wanted justice or risk having the case dropped. Doyle said that in the Philippines, it is necessary for the family to be fully involved in the justice process.

Arrest warrants were issued in August for Jane Doyle, Jeffrey and Jhonny Parian, two brothers who are accused of carrying out the shooting. Harry Doyle’s former driver and bodyguard, Jerome Devocion, who is also charged in the case, was already in custody awaiting trial on another matter in August. Joan Doyle said the family hired Alfonso Casurra, a lawyer in the Philippines to represent them. She said he contacted her and her sister Anne Doyle in August to inform them that the arrest warrants had been issued. “We asked our attorney, Casurra, to expedite the extradition process and to give us any information that we needed if there were any further actions to be taken,” said Joan Doyle. She said it wasn’t clear that the family was required to contact the Philippine Embassy in Ottawa to request that the process go ahead. “We did not understand that we needed to write a letter to the Philippine Embassy in Canada until this month,” Joan Doyle said. She said once they understood that they needed to make that request, they did. The matter is moving ahead.

 

“There is a process and, unfortunately, it’s time consuming,” said Joan Doyle. “It doesn’t go at the pace that we would prefer ... We’re satisfied at this point that the process is unfolding. As far as we know the extradition is with Interpol and it’s in process.” She said the family is taking the matter day by day and is refusing to get their hopes up. “To get hopes up is just to be stressed. We are trying to manage the stress,” Joan Doyle said. She said the family isn’t concerned Jane Doyle could leave the country before the arrest warrant is served. “We have no concerns about her fleeing,” Joan Doyle said.

Joan Doyle said the family has been communicating with Fredericton MP Keith Ashfield and his staff. She said Ashfield and his executive assistant, Kevin Price, have been supportive since the start of their ordeal. “Keith knew Harry personally because Harry was a card-carrying member of the Conservative party,” Joan Doyle said. “Kevin Price has been wonderful to us from the beginning.” Ashfield said no request for extradition has come from the Philippine Embassy in Ottawa on the matter to date. He said the Department of Justice is in contact with its Philippine counterparts about the case. “Any of these international processes take time,” Ashfield said. “To compound the situation, we have the tragedy that’s taking place in the Philippines, which I am sure is slowing things up as well. I think we just have to bide our time and work through this process.”

Yesterday morning I was in a Surigao City courtroom with my friend Arnel (Harry's former driver). Arnel’s lawer Mr. Atty. Casurra had asked me to handle the pickup and transporting of Arnel to the courtroom that morning. Arnel has been in hiding as are all witnesses due to fear for their personal and family safety. Arnel in 2012 was chased by two motorcycles and shot off his bike when he was struck in his back by a .45 round during the motorcycle chase through the city. The shooting has left him permanently paralyzed from the chest down probably for the rest of his life. There is a real and present fear that his health is quickly diminishing due to complications from the shooting. Arnel is a first cousin of Jane Doyle but it is believed that Jane and Harry Doyle had a 50,000p bounty on both Arnel and Miss. Kima.

 

It is believed that the strategy of Jerome Dovecian’s lawyer atty. Zerda has been to purposely stall the case as long as possible in the hopes that Arnel would either be unable to attend the courtroom, not have the funds to continue with the case, or that he would simply died from his injuries. Arnel’s lawyer Mr. Atty. Casurra is a very clever bird and a seasoned trial attorney. He had me assist moving Arnel to the court so he could be presented before the judge with a request to try to schedule as early a trial date as possible due to health concerns. The judge agreed and set the trial date for this coming February 3rd. Afterwards a security team escorted Arnel and he has since been relocated and back into hiding where only Atty. Casurra himself can reach him before the upcoming trial. It was good to see my friend again and I know he is in good hands and is well protected.

 

Jerome Dovecian is presently facing three separate cases surrounding the Doyle household which he is believed to be directly involved. There is the Arson case involving Miss. Kima's family home where she and her family members barely escaped the flames with their lives (7 attempted murders), the shooting case involving Arnel (1 attempted murder), and the Parricide charge involving Harry's murder. He is also the primary suspect in a forth case of the stabbing and shooting death of a retired PNP officer here in Surigao City. Jerome was out on bail (paid by the Doyles) for the shooting of Arnel but an arrest warrant was issued in the Miss. Kima arson case which has him in a jail cell.  When Jerome was picked up and arrested he had been very active trying to intimidate all the witnesses, and PNP investigators, with the assistance of the two Parian brothers. Presently Jerome and Jeffery Parian are both still in lockup awaiting multiple trials. Jane is still in Canada living in Harry’s hometown. Johnny Parian is still at large but I suspect that soon he will be either captured or killed, but I hope the PNP capture him alive. I wonder if once they have all four suspects in jail cells, just how long before they start flipping and turn on each other like a pack of jackals?

 

I also talked to Arnel’s lawyer Atty. Casurra, who also represents the Harry’s Canadian family interest in the murder case of Harry Doyle. He told me he has tracked down the official authenticated case file (Harry Doyle murder case) and arrest warrant (Jane Doyle). He will be personally travelling up to Manila and will go to Camp Crome where the Chief PNP offices and those of INTERPOL are headquartered so these documents can be finally take the final steps needed so the arrest warrant for Jane Doyle can then be transferred by INTERPOL to the RCMP in Canada. I believe that when Jane Doyle is served the arrest warrant that she will be taken into custody until which time she is to appear for the first extradition hearing. From what I have been able to ascertain the extradition hearing will be at least six months after her arrest.
